Bloggers in the process of handling criminal cases have found many local legal aid institutions assigned non lawyers to defend aid to criminal suspects and defendants, the assigned some called legal aid workers, some of it is the legal work of grassroots legal service institute. The legal aid institutions assignment is a violation of "criminal procedural law" the regulation of the people's Republic of China, according to the provisions of the law in criminal cases investigation, review and prosecution, whether the trial stage to provide legal aid to criminal suspect or defendant's Counsel must be lawyers, lawyers shall not be assigned in non criminal legal aid cases.

   But for this phenomenon both legal aid agencies or the courts are not paying attention, the judge almost does not examine whether the legal aid agencies assigned to legal aid workers is a lawyer, as long as there is a man sitting in the defense table, the formal trial for legal aid clients is unfair, especially in death penalty cases, juvenile crime, non lawyers can not effectively protect the legitimate rights of the parties.
