   Hunger breeds discontentment, food safety first. Food safety is directly related to people's health and life safety, related to the healthy development of the country's future, related to social harmony and stability. In recent years, due to the frequent incidents of food safety have been highly valued by our party and government. In the new environment, to deal with the new situation, new problems in 1995 promulgated the "the people's Republic of China Food Sanitation Law" on the function is hard. After another outbreak of the melamine milk powder, such as tonyred, "malachite green" duck's egg tonyred, clenbuterol, the food safety events have directly promoted the "food safety law" formulation and production.

   However, the food safety problems on June 1, 2009 implementation of the "food safety law" does not put things right once and for all solution in reality, the new law in actual operation and implementation process, in the new situation to deal with the increasingly complex also will have many beat all the complicated situation. At the same time, the food safety problem in legal way radical, corporate conscience, social public safety awareness is indispensable.

   Food safety problems in rural areas, is an important part of the global food security, food security situation in rural masses directly affect the food safety regulation effect. The food safety law of the people's Republic of China(part)

Article secondTo engage in the following activities within the territory of the people's Republic of China, shall abide by this law:
(a) the food production and processing (hereinafter called food production), food circulation and catering services (hereinafter referred to as the food business);

(three) used for food packaging materials, containers, detergent, disinfectant and used for food production and management tools, equipment (hereinafter called food related products) of the production and business operation;

Article twenty-seventhThe food production and business operation shall meet the food safety standards, and meet the following requirements:

(nine) water shall conform to the state provisions of the sanitary standard for drinking water;
(ten) detergents, disinfectants used shall be safe, harmless to the human body;
(eleven) other requirements prescribed by laws and regulations.

Article twenty-eighthNo production and business of the following foods:
(a) adding the chemical food additives outside and other substances potentially hazardous to human health food with non food raw materials for the production of food or food, or recycled as a raw material for production of food;

(five) operation mortality, poisoning or some unknown cause, livestock, poultry, aquatic animal animal meat, products or production operations, poisoning or death of unknown cause, livestock, poultry, aquatic animal meat;
(six) business without the mechanism and quarantine or quarantine unqualified meat animal health supervision, or the production and business operation without inspection or inspection unqualified meat products;
(seven) operating over the shelf life of food;

      Consumer Protection Law(part)

First chapter  General provisions

Article 1 this law is formulated in order to protect the legal rights and interests of consumers, to maintain social and economic order and to promote the healthy development of the socialist market economy.

Second consumers need for life purchase, use of goods or receiving services, protection of its rights under the law; the law does not specify, protected by other relevant laws, rules and regulations.
Third operators provide consumers with the production, sales of commodities or providing services, shall comply with this law; no provisions of this law, shall comply with the provisions of other relevant laws, rules and regulations.
Fourth operators and consumer transactions, should follow the voluntary, equality, fairness, honesty and credit principle.
Article fifth country to protect the legitimate rights and interests of consumers are not infringed.

                                       To solve the sixth chapter controversy

Thirty-fifth of consumers in the purchase, use of goods, the legitimate rights and interests are infringed, may demand compensation from the seller. A consumer or other injured party whose person or property is harmed due to a commodity defect may demand compensation from the seller or may also demand compensation from the producer.                        The seventh chapter legal liability
The fortieth operator providing commodities or services in any of the following circumstances, except as otherwise provided in this law, shall be in accordance with "the people's Republic of China product quality law" and other relevant laws and regulations, shall bear civil liability:
(1) where a defect exists in a commodity.
(2) where a commodity does not possess functions it should possess, and this is not stated when the commodity is sold.
(3) where the commodity standards indicated on a commodity or on the package of such commodity are not met.
(4) where the quality condition indicated by way of commodity description or physical sample, etc, is not met.
(5) where commodities pronounced obsolete by formal State decrees are produced or have expired or deteriorated commodities are sold.
(6) where a commodity sold is not adequate in quantity.
(7) where the service items and charges are in violation of an agreement.
(8) where demands by a consumer for repair, redoing, replacement, return, making up the quantity of a commodity, refund of a commodity purchase price or service fee or claims for compensation have been delayed deliberately or rejected without reason; or.
(9) in other circumstances whereby the rights and interests of consumers, as provided by laws and regulations, are harmed.
Forty-first operators to provide goods or services to consumers or other victims, resulting in personal injury, medical fees, nursing fees shall be paid, during treatment for lost wages and other expenses, disability, it shall pay the life of the disabled self-help fees, living allowance, disability compensation and the maintenance man the necessary living expenses; constitutes a crime, shall be investigated for criminal responsibility according to law.

Where a consumer requires a business operator to repair, replace or return a large commodity of which the repair, replacement or return is guaranteed, the business operator must bear reasonable expenses such as freight.
Article forty-sixth the operators to provide goods by mail order, should be provided in accordance with agreed. If the business operator fails to do so in accordance with the agreement, it must, at the request of the consumer, implement the agreement or refund payment and bear reasonable expenses needed to be paid by the consumer.
Forty-seventh operators to provide goods or services for advance payment, should be provided in accordance with agreed. (4) where the place of origin of a commodity is fabricated; the factory name or address of another party is fabricated or used without authorization; quality marks such as certification marks, famous brand marks or marks of excellence are fabricated or used without authorization.

(5) where a commodity subject to inspection or quarantine is sold without inspection or quarantine or where inspection or quarantine results are falsified.

(6) where false and misleading advertising for a commodity or a service is carried out.
